DELIVERY POLICY

Huaguoshan Inc. (“HGS,” “we,” “us,” or “our”)

By placing an order with Huaguoshan Inc., the customer acknowledges and agrees to this Delivery Policy, together with our Terms and Conditions, Refund and Cancellation Policy, Food Safety and Storage Policy, and Privacy Policy.

1. Customer Responsibility for Delivery Information

Customers are responsible for providing a complete, accurate, and deliverable address when placing an order.

Before submitting an order, customers must carefully verify all delivery information, including:

  • Street number and street name
  • Apartment, unit, suite, or building number, if applicable
  • City and ZIP code
  • Delivery instructions, when applicable
  • Current telephone number and contact information

When entering an address at checkout, the street address must be entered in the appropriate street-address field, and any apartment, unit, or suite number must be entered in the designated apartment/unit field.

HGS is not responsible for delivery problems, delays, failed deliveries, or losses caused by incomplete, inaccurate, improperly formatted, or outdated information supplied by the customer, except as otherwise required by applicable law.

2. Review Your Order Confirmation

After placing an order, customers should carefully review the order confirmation, including the delivery address.

The confirmation provides an additional opportunity to identify an incorrect or incomplete address.

If an error is discovered, the customer should contact HGS as soon as possible. Address changes remain subject to the deadline described below.

3. Address Changes — Three-Day Advance Notice

Requests to change a delivery address must be received by HGS at least three (3) calendar days before the scheduled delivery date.

Address-change requests received less than three calendar days before delivery, including same-day requests, may not be accommodated.

This policy is necessary because meal production, delivery routes, driver assignments, and other operational arrangements may be established in advance.

Customers should not assume that an address has been changed unless HGS has confirmed the change.

4. How an Approved Address Change Is Handled

When an eligible address-change request is received at least three calendar days before the scheduled delivery date, HGS may cancel the affected original order and issue the eligible amount as HGS store credit.

The customer may then use the store credit to place a new order using the correct delivery address.

Store credit is not the same as a refund to the customer's original payment method.

HGS may, at its discretion, issue a refund to the original payment method when appropriate. Nothing in this policy limits any refund, credit, or other remedy required by applicable law.

5. Incorrect or Incomplete Addresses

If an order is delivered according to the address and delivery information submitted by the customer, HGS is not responsible for loss resulting from the customer's incorrect or incomplete address information.

This includes, for example, a missing or incorrect apartment number, unit number, building number, street number, access instruction, or other information necessary to complete delivery.

Customers are therefore strongly encouraged to verify their delivery information both before checkout and immediately after receiving their order confirmation.

6. Delivery and Proof of Delivery

HGS drivers may document completed deliveries using proof of delivery, which may include a photograph, delivery timestamp, delivery location information, driver records, or other available delivery records.

Where appropriate, the driver may photograph the order at the designated delivery location before leaving the property.

Delivery photographs and related records may be retained by HGS for legitimate business purposes, including confirming delivery, responding to customer inquiries, resolving disputes, preventing fraud, and maintaining delivery records, consistent with our Privacy Policy.

7. Unattended and Contactless Deliveries

If the customer is unavailable to personally receive an order, the driver may leave the order at a reasonably appropriate location at the delivery address, such as the front door, lobby, reception area, or another location specified or authorized by the customer, when reasonably feasible.

Customers who know that they will not be present at delivery are responsible for making appropriate arrangements to receive, retrieve, or promptly refrigerate their order.

8. Theft or Loss After Confirmed Delivery

Once HGS has delivered an order to the correct address and designated or reasonably appropriate delivery location and has documented the completed delivery, the customer is responsible for promptly retrieving and securing the order.

Subject to applicable law, HGS is not responsible for theft, disappearance, loss, tampering, weather exposure, animal interference, or other events occurring after a properly completed delivery that are outside HGS's reasonable control.

This includes packages removed by third parties after the driver has completed and documented delivery.

Customers who live or work in locations where unattended deliveries may be at greater risk should make arrangements to receive the order promptly whenever possible.

9. Safe and Accessible Delivery Locations

Customers are responsible for providing reasonable and lawful access to the delivery location.

HGS does not require its drivers to enter a location or remain in circumstances that the driver reasonably believes present an immediate safety risk.

If safe or reasonable access is unavailable, HGS may attempt to contact the customer or use another reasonable delivery procedure, depending on the circumstances.

10. Perishable Food and Prompt Refrigeration

HGS meals and other perishable products are freshly prepared and may be made without added preservatives.

Customers should retrieve delivered food promptly.

If the food will not be consumed immediately, customers should promptly place perishable items under appropriate refrigeration and follow all storage, handling, and reheating instructions supplied with the product.

Perishable foods requiring refrigeration should generally be maintained at 41°F (5°C) or below, unless product-specific instructions provide otherwise.

Food should not be consumed if the customer has reason to believe that it has been stored or handled in an unsafe manner.

For best taste and quality, HGS may recommend consuming certain freshly prepared meals on the day of delivery.

11. Responsibility After Delivery

Following a properly completed delivery, customers are responsible for the appropriate retrieval, refrigeration, storage, handling, and reheating of their food.

Subject to applicable law, HGS is not responsible for spoilage, deterioration, loss of quality, or food-safety problems caused by circumstances occurring after proper delivery, including:

  • Failure to retrieve an order promptly;
  • Leaving perishable food unrefrigerated for an unsafe period;
  • Improper refrigeration or storage;
  • Improper reheating;
  • Mishandling after delivery; or
  • Failure to follow product-specific storage or preparation instructions.

Nothing in this section excludes responsibility that HGS cannot lawfully exclude, including responsibility for matters attributable to HGS before or during delivery where applicable law provides the customer with a remedy.

12. Delivery Delays and Circumstances Beyond Our Control

Delivery times may be affected by traffic, weather, road closures, vehicle problems, building access, emergencies, government actions, or other circumstances outside HGS's reasonable control.

Delivery estimates or windows are estimates unless HGS expressly states otherwise.

HGS will make reasonable efforts to complete scheduled deliveries, but cannot guarantee an exact arrival time when circumstances outside our reasonable control interfere with delivery.

13. Reporting a Delivery Problem

Customers should contact HGS promptly if they believe:

  • Their order was delivered to the wrong address;
  • Their order was not delivered;
  • Items are missing;
  • The order was damaged before or during delivery;
  • There is a food-quality or food-safety concern; or
  • The delivery otherwise materially differs from the order.

Customers should provide the order number and relevant information or photographs, when available, so that HGS can investigate.

HGS may review delivery photographs, timestamps, driver records, order information, customer communications, and other relevant records when investigating a claim.

14. Refunds and Store Credits

Eligibility for a refund, replacement, or store credit is governed by the HGS Refund and Cancellation Policy and applicable law.

HGS may provide store credit for eligible customer-requested changes or cancellations as described in our policies.

When a problem results from an error attributable to HGS, HGS may determine an appropriate remedy based on the circumstances, including replacement, store credit, or refund to the original payment method, subject to applicable law.

15. Acceptance of Delivery Policy

By placing an order, the customer acknowledges that they have had an opportunity to review this Delivery Policy and agree to comply with its applicable terms.

Customers are responsible for reviewing their order information before completing checkout and reviewing the delivery information shown in their order confirmation.

HGS reserves the right to update this Delivery Policy from time to time. The version applicable to an order will be the version in effect when the order is placed, except where otherwise required by law.
